"Today, for the purchase of an apartment in Polish banks in debt is several hundred 
thousand people. Considering the fact that the problem also applies to the whole family, 
it should be noted that this problem may affect a much larger number of inhabitants 
(although exact statistics are not known). For example - according to some data - a group 
of so-called debt. frankowiczów counts approx. 560 thousand. people. In 2000. Debt of 
Polish men and women for the purchase of housing was estimated at approx. 9.5 billion zl. 
(mortgages), now it is approx. 378 billion zl. The debt in this respect therefore 
increased by nearly 3900%, when inflation in the same period amounted to approx. 43%. With 
mortgages it is - according to various estimates - 11-12% of households.

Many indebted families lose the right to occupy an apartment, which is the only place 
where they can meet the basic housing needs. The direct cause of the loss of the apartment 
is the cessation of repayment of the loan to the bank or the developer or other entities. 
Loss of liquidity is mainly due to high mortgage installments (often previously 
denominated in Swiss francs). The reasons for this are various, eg. Related to loss of 
earning capacity due to illness or other circumstances which are independent of the 
borrowers. At the time of lack of liquidity payments, it comes to the auction (announced 
by the bank or other entity, eg. The developer) and the loss of the right to occupy an 
apartment. The new owner based on the act of acquisition and transfer of ownership 
housing, can - without having to bring the case to court - immediately start proceedings 
with the participation of the bailiff that "the march" on the order of eviction made.

Curious in this case is the fact that the person / family who has lost the right to 
housing as a result of the auction and transfer of ownership is not subject to the rigors 
of the law on protection of the rights of tenants. This means that the location of such a 
person / family - from a legal point of view - is far worse, the position of the indebted 
tenant who does not have and never had title to the occupied locale, and such. Rented it 
on the market, or got in the past, the right to occupied housing on the basis of communal 
lease scheme. Then the tenant subject to the Act on the Protection of the rights of 
tenants ... and they are entitled to, among others, the right to social housing. In the 
circumstances defined by law, the courts are obliged to grant social housing (including 
eg. The disabled, pregnant women, children, the unemployed etc.). All such tenants also 
includes eg. A prohibition on so-called eviction. period of protection, which is the 
winter (from November 1 to March 31). These rules however do not apply to people who have 
lost the right to their previously held units, due to their assignment to another owner. 
In such circumstances - in the majesty of the existing regulations - depriving them not 
only of the right to social housing, but also protection from eviction during the winter. 
This means that Polish law discriminates against a specific group of people.

Greater Tenants Association has more and more intervention on the people who lost their 
right to premises in the circumstances described above, and found themselves in a dramatic 
situation. We have therefore decided to apply to the Ombudsman with a request to take a 
position in the above-described case and the opinion. We appeal to the government with a 
request to take appropriate legislative changes in this regard.

At the same time we start the campaign, whose main postulate is to cover people losing 
their right to the premises as a result of the transfer of ownership, which provided 
similar protection in other cases (referred to by the Act on the Protection of the rights 
of tenants ...). The current legislation clearly submit to the ownership of the right to a 
"homeless" and are beneficial to banks and developers, at the expense of residents. This
