King's Cross arson theory 'being ignored'

The theory that an arsonist caused the King's Cross Underground fire is being unfairly dismissed at the public inquiry into the disaster, according to some of the lawyers and experts taking part.
As the inquiry into the fire, in which 31 people died, enters its third week today, tensions are mounting among the rejection of the arson theory before evidence about it has even been heard.
Dismay has been voiced privately to Mr Desmond, Fennell, QC, chairman of the inquiry, and may have led him to a surprise decision last week to give lawyers concerned about possible arson more time to prepare their cases.
One of the interested parties told The Times. 'It really is outrageous that the evidence of some witnesses is being dismissed before they are even called and the evidence of others is being ignored.'
Council for London Regional Transport and its subsidiary London Underground have told the inqiury that arson cannot be rejected, but one leading lawyer who is taking part said yesterday: 'While London Transport would like to keep the arson theory in play, the inquiry is firmly of mind to say it is not a runner.'
The discovery of two separate incidents at King's Cross on the night of the fire three months ago added credence to the arson theory.
Both appear to have been dismissed already by Mr Roger Henderson, QC, who is presenting the evidence gathered for the inquiry on behalf of the Treasury Solicitor.
Three witnesses came forward to say that at between 7.15 and 7.20 pm. immediately before the fire is believed to have started on a Piccadilly Line escalator, they saw a man in blue overalls climbing in and out of an inspection hatch at the foot of the Piccadilly Line escalators.

Three witnesses described having seen him shortly before the fire, which killed 31 people, was discovered. He was near a trap-door leading into a machine room at the foot of the escalator on which the inferno began.
There has so far been no explanation of what this man was doing. His presence has led London Regional Transport to say that arson cannot be ruled out.
Mr Ilfay Mehmet, of Paddington, west London, said he saw a man in dark overalls 'going underneath the ground'.
The man caught his eye. 'I don't know why he did. The disturbed look on his face told me that everything was not as it seemed', Mr Mehmet said.
Mr Dennis Hills, a part-time cleaner at the station, described seeing a man beside the trap-door close to the wall.
'I heard a clang and the man walked away. For some reason I thought he was up to something. He may have looked up and seen me in my overalls with my London Transport symbol on it, and in my opinion he moved away very quickly.'
The arson theory was promoted widely by London Regional Transport and some newspapers.
Enquiries by Det Supt Anthony Clift of the British Transport Police invited Mr David Halliday, a fire investigator at the Metropolitan Police Forensic Science Laboratory, to examine the scene and within two days Mr Halliday had reached the preliminary conclusion that there was no evidence to suggest that the fire had been started deliberately.
