This Indian delicacy came to the IPKat's attention today, from the Economic Times. The Delhi District Court has been asked to stay the preliminary round for choosing participants for the Kaun Banega Crorepati-2 TV game show, hosted by Amitabh Bachchan, by four Mumbai-based claimants who are asserting patent rights over the selection process adopted by Star India. That company, counterclaiming for the patent's cancellation, maintains that the claimants' patent was fraudulently obtained and that it had in any event been anticipated by earlier foreign patents. As the District Court has no jurisdiction to determine the validity of a patent, this matter has been referred to the Delhi High Court.
Amitabh Bachchan: hosting an infringing programme?
The IPKat hopes to learn more about this litigation. He recalls Lord Justice Jacob, at this year's Fordham Conference, condemning IP grants that serve no useful industrial or commercial end and wonders whether this one -- which might well be regarded as unpatentable under Article 52 of the European Patent Convention as a way of doing business or playing a game -- would stand up to his Lordship's critical scrutiny.
