RECENTLY REPORTED COPYRIGHT CASES

Issue 5 of Sweet & Maxwell's European Copyright and Design Reports has now been published. Apart from Arrmet's case -- the first decision on the validity of a Community design from the Office for Harmonisation in the Internal Market's Invalidity Division (available on the OHIM website in Italian), this issue has a couple of reports which are available in English for the first time:

* Church of Spiritual Technology and others v Dataweb BV and others (Court of Appeal of the The Hague) on the unauthorised inclusion of literary works in web pages; and

* Butti ed Assicurati SAS v Gigli e Meglio Srl (Supreme Court, Italy) on the right to use ideas generated in commissioned advertisement contracts.

If you know of any interesting European copyright or design cases that you'd like to see reported in English, write and tell the IPKat here.
